1. Agreement and service
These Terms govern your use of Agent Duel applications, hosted services, and related features provided by Bottomless, Inc. ("Agent Duel," "we," "us," or "our"). By affirmatively accepting these Terms, you agree to them. If you use Agent Duel for an organization, you represent that you have authority to bind that organization and authorize the access and uses described here.
Agent Duel provides software development and AI evaluation tools. Features may include executing agents, accessing project files and external resources, comparing results, collecting evaluations, and recording development activity. Features, model availability, limits, and pricing may change. Any charge to you will be disclosed before you agree to incur it. You must be at least 18 and legally able to enter this agreement.
2. Work Data and authorized sources
"Work Data" means information and materials relating to work you perform, request, develop, inspect, evaluate, or continue through Agent Duel. It includes existing and newly created prompts, instructions, conversations, model outputs and available reasoning traces; source code and complete project files; repository contents, branches, commits, history, snapshots, patches and changes; documentation, tests, test results, builds, terminal commands and outputs; attachments, images, screenshots and other media; tool calls and results; votes, ratings and feedback; and usage, interaction, timing, performance, diagnostic, and work-quality information.
"Authorized Sources" means projects, repositories, local directories, development environments, accounts, services, integrations and other resources you select, connect, or authorize for work-related discovery or access; related resources accessed through those sources within the permissions granted; and lawful publicly accessible sources relevant to that work.
You authorize Agent Duel and its tools and service providers to access, inspect, search, discover, read, monitor changes in, copy, transmit and collect Work Data from Authorized Sources through the features and permissions you enable. Collection may be automatic and is not limited to content you manually paste or upload. Within those sources and permissions, it may include earlier versions, related files and context, and changes made through other editors or tools. Where ongoing discovery is enabled, it may continue while the authorized connection remains active.
This authorization does not grant rights you do not possess, override an access control, or authorize access outside the relevant permissions. Expanded access to additional private sources requires the applicable authorization. Personal information is handled as described in the Privacy Policy and applicable law.
3. Ownership and broad content license
You and the applicable rights holders retain ownership of Work Data. To the extent you own or are authorized to license the relevant rights, you grant us a worldwide, nonexclusive, royalty-free, fully paid, transferable and sublicensable license, through multiple tiers, to access, collect, host, retain, reproduce, analyze, label, annotate, combine, modify, adapt, translate, create derivative works from, publish, publicly display and perform, distribute, license, sell and otherwise commercially exploit Work Data.
This license covers Work Data in raw, identifiable, de-identified, aggregated and derived forms, individually and in combination with other information, subject to the personal-information limitations below. Its purposes include providing and securing services; research and benchmarking; evaluating agents, models, users' interactions and work; training, fine-tuning, testing and improving AI models and other systems; developing products and analytics; creating datasets; and publishing, licensing or selling datasets, content, analyses and other products to customers, researchers, model developers and other third parties. For content that is not personal information, the license also covers other lawful purposes.
The license permits recipients to exercise the licensed rights and use licensed material for their own permitted purposes. You will not be entitled to royalties, attribution, approval of individual uses, or additional payment for those uses unless separately agreed or required by law.
Subject to applicable law, the intellectual-property license is perpetual and irrevocable and survives stopping use or closing an account. These provisions do not make privacy consent irrevocable, permit unlawful retention, or waive access, deletion, withdrawal, objection, opt-out or other rights that cannot be waived. Uses of personal information remain subject to the Privacy Policy, applicable choices, and a valid legal basis.
We retain rights we lawfully hold in our software, services, models, annotations, analyses and dataset arrangements. This does not transfer ownership of underlying user or third-party materials to us or create exclusive ownership in facts.
4. Authority and confidential information
You must have the rights and permissions needed for the access, collection and uses you authorize. Merely being able to open a file or view a repository does not establish that you may authorize its publication, resale, or use for model training. Employer, client, collaborator and open-source rights continue to apply.
Do not provide or expose credentials, private keys, regulated sensitive information, or other people's confidential material unless you have the required authority and the feature is appropriate for that information. Agent Duel does not promise that Work Data is automatically anonymized or stripped of secrets. Except as expressly agreed in writing, Work Data is not submitted under a duty of confidentiality that would prohibit the uses disclosed in these Terms and the Privacy Policy.
5. Agents and third-party models
Depending on your instructions, enabled features and permissions, agents may read and change files, execute commands, access networks, interact with external services and produce outputs. Review consequential actions and maintain appropriate backups. AI outputs may be incorrect, insecure, incomplete or nonunique, and you are responsible for deciding whether they are suitable for your use.
We use third-party infrastructure, model routers and model providers. Their applicable model and service requirements may restrict inputs, outputs and permitted uses. When using hosted models, you must comply with applicable model-use requirements, including OpenRouter's Terms (https://openrouter.ai/terms) and the applicable provider terms referenced in its provider directory (https://openrouter.ai/docs/guides/routing/provider-selection#terms-of-service). The applicable requirements depend on the model and provider used. Our license does not enlarge rights in third-party material or override model-provider restrictions.
6. Accounts and acceptable use
Provide accurate account information and protect your credentials. Promptly report suspected unauthorized access to hello@bottomless.com. Do not use Agent Duel to violate law or third-party rights, bypass access controls, interfere with services, introduce malicious code, or obtain data you are not authorized to access. We may impose reasonable service limits and suspend access to address abuse, security, legal requirements or material violations of these Terms.
7. Privacy and changes
The Privacy Policy explains collection, processing, recipients and available choices. Acceptance of these Terms is not a substitute for separate privacy consent where required.
We may update these Terms prospectively by providing notice and an effective date. We will obtain further acceptance or consent where required for material changes, new data uses or expanded access. Mandatory rights and choices remain effective.
8. Ending use
You may stop using Agent Duel and disconnect sources. You may request account closure or exercise applicable privacy rights using hello@bottomless.com. Disconnection stops future collection through the disconnected permission to the extent controlled by that connection; it does not itself erase previously collected information. Retention and permitted ongoing uses remain subject to the Privacy Policy and applicable law, including the deletion commitment in that Policy.
9. Warranties and liability
To the extent permitted by law, Agent Duel is provided as available and without warranties of merchantability, fitness for a particular purpose or noninfringement. We do not warrant uninterrupted availability, error-free outputs, or preservation of every local or cloud record.
To the extent permitted by law, we are not liable for indirect, consequential, incidental or special losses, lost profits, or lost data arising from the service. Our aggregate liability arising from these Terms or the service will not exceed the greater of USD 100 and the amounts you paid us for the service during the twelve months preceding the event giving rise to the claim. These limitations do not exclude liability or consumer rights that applicable law does not allow us to exclude.
10. General provisions
If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. These Terms do not replace third-party open-source licenses governing the software you receive.
